Agreement
These terms apply to your use of ownyourecommerce.com (the "site"), which is operated by Own Your eCommerce ("we", "us", "our"). By using the site, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the site.
Services and client agreements
The site describes the custom eCommerce design, development, hosting setup, and support services we offer. Any work we do for you is governed by a separate written agreement, such as a signed proposal or statement of work, which sets out the scope, price, timeline, and who owns what. If that agreement conflicts with these terms, the agreement wins. Nothing on the site is an offer you can accept just by using it.
Using the site
You're welcome to use the site to learn about our services and to contact us. You agree not to:
- use the site in a way that breaks the law or infringes anyone's rights;
- try to gain unauthorized access to the site, our systems, or anyone else's data;
- disrupt the site, for example by overloading it or introducing malware;
- scrape or copy the site in bulk, or use it to build a competing service;
- send spam or submit false or misleading information through our forms.
Our content
The site's text, design, graphics, logo, and code belong to us or our licensors and are protected by intellectual property laws. You may view the site and share links to it, but you may not copy, modify, or republish its content without our written permission, except as the law allows.
Other company and product names mentioned on the site, such as Shopify, Wix, Helcim, FedEx, UPS, QuickBooks, and Xero, are trademarks of their respective owners. Mentioning them doesn't mean they endorse us or that we're partners.
Estimates and examples
Savings estimates, fees, timelines, uptime figures, and other numbers on the site are general information based on typical projects and publicly available provider pricing. They aren't quotes or guarantees. Your actual costs and results depend on your business and will be set out in your proposal.
The dashboards, customer names, orders, and figures shown on the site are illustrative examples, not real customers or data.
What you send us
You're responsible for the information you send us, and you confirm you have the right to share it. Please don't send confidential information until we've agreed how it will be protected, for example under a non-disclosure agreement. Our Privacy Policy explains how we handle personal information.
Third-party services
The site links to and relies on services run by other companies, such as payment processors, shipping carriers, hosting providers, and our form and font providers. We don't control them and aren't responsible for their content, policies, or availability. Your use of them is governed by their own terms.
Disclaimers
We work hard to keep the site accurate and available, but it's provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the site will be error-free, uninterrupted, or free of harmful components.
Limitation of liability
To the fullest extent the law allows, Own Your eCommerce isn't liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the site. Our total liability for any claim relating to the site is limited to US$100. Some places don't allow these limits, so they may not all apply to you. This section doesn't change the liability terms of a signed client agreement.
Indemnity
If you misuse the site or break these terms, you agree to cover the reasonable costs, including legal fees, that we incur as a result, to the extent the law allows.
Governing law
These terms are governed by the laws of the US state in which Own Your eCommerce is organized and applicable US federal law, without regard to conflict-of-law rules. Any dispute relating to the site will be handled exclusively in the state or federal courts located in that state, and you and we consent to their jurisdiction.
Changes
We may update these terms from time to time. The "Last updated" date at the top shows when they last changed. If you keep using the site after an update, you accept the new terms.
